Terms of Service

These terms and conditions (“Terms”) govern the access to and use of the Think Track website and control panel (“Platform”), the Think Track client software (“Software”), and Think Track services (“Services”) of It Think Zone Pvt. Ltd. (the “Company” or “we/us”), made available to users (“you” or “user/s”) via the Software and at http://www.thinktrack.app.

1. Think Track Services and Platform

Think Track: Think Track provides services for monitoring and controlling use of computer devices owned by you, for controlling use of these devices by your Users when and to the extent such activity is permitted by applicable law and without infringing any third-party rights (including Users’ fundamental rights) or other applicable regulations.

Think Track includes optional services for secure browsing and searching. This includes a service for monitoring and storing online activity reports and content of communications, in particular social networks, and for blocking certain categories of sites, at your option.

Think Track provides a dashboard on the Platform for enabling you to configure the level and degree of monitoring of the computers and other devices associated with the account. You are solely responsible for how such dashboard controls are configured and the processing of personal data as a consequence, including its collection, storage, and analysis on the Platform. Think Track only implements automatically the configuration and instructions provided by you.

Think Track is a work in progress, and we reserve the right to modify or temporarily suspend the Think Track services at any time for any reason. Notice of any suspension will be given in accordance with these Terms.

Platform: The Think Track Platform provides access to the Think Track online control panel and feedback forms. Through the Think Track Software and Platform, we enable registered users to access and use our Think Track Services, subject to these Terms.

Ownership: We own or are the licensee of all intellectual and industrial property rights in Think Track. Access to and use of our web-based services and content does not imply any transfer of all or part of these rights to you.

Trademarks: You will not use our trademarks, trade names, logos, domain names, other distinctive brand features, or any copyrighted material associated with Think Track without our consent.

Privacy Policy: Think Track enables you to process personal data of Users under your control. Our Privacy Policy is part of these Terms and is set out at: http://www.thinktrack.app/privacy.html.

Service Provision: We use reasonable endeavours to make the Platform and Services available to you at all times, but we shall not be liable for interruptions or downtime. Due to maintenance, security, or capacity issues, and events beyond our control (e.g., network issues, power outages, etc.), services may be temporarily suspended or affected by brief anomalies.

Security: You understand that the Think Track Software and Service can be used for transmission of content to the Platform, collected from the devices associated with your account, and that during processing, your User Content—including contact names, emails, or IM communications—may be transferred (encrypted) over the internet. Currently, data are not stored in an encrypted manner, as this would prevent the monitoring and filtering services.

Support: We try to provide the Think Track Service 24/7; however, due to maintenance, security, or capacity issues, and also to some events beyond our control (force majeure), the Platform and Services may be temporarily suspended or affected. Our support policy is set out at www.thinktrack.app.

2. You/Users and Registration/Termination

About You and Your Users: You warrant that you are over 18 and the owner or lessee of the devices in which the Software associated with your online account is installed. You warrant that you have notified any User over 14 years old that the device includes control and monitoring software and that you have their consent. You undertake to fully comply with our Privacy Policy, which is incorporated herein.

Registration: Registration and creation of a Think Track account are required to use the Think Track Services. To register, you must complete the corresponding form with your details (email and name) and agree to these Terms. You warrant that this information is and will remain correct and accurate.

Activation: Access to the Think Track Service is typically immediate. We reserve the right to refuse the Think Track Services to anyone for any reason. Upon account confirmation, you are granted a limited, revocable, non-exclusive, and non-transferable license to use the Think Track Service in accordance with these Terms.

Transfer of Ownership: Confirmation from the current account owner is required to transfer ownership. To request a transfer, you must contact us at Contact@thinktrack.app from the registered email address.

Passwords: You are responsible for safeguarding your passwords and ensuring their correct use. Notify us immediately upon learning of any unauthorized use of your account or breach of security.

Termination: You may cancel your account at any time by contacting Contact@thinktrack.app. No refunds are given for early termination. We may suspend or cancel your account in case of breach of these Terms.

3. Use of Think Track Services

Proper Use: You agree to use the Think Track Platform and Services in accordance with these Terms and applicable law. In particular, you will use the Software and Services in compliance with applicable privacy, telecommunications, and labour laws.

Responsibility for Use: You are responsible for all activities undertaken under your account. You are the data controller of all personal data collected and submitted via the Think Track Service, and Think Track is the data processor.

Prohibited Uses: You agree not to use or permit the use of Think Track to monitor or control users’ devices under conditions that violate the law or user consent requirements.

4. User Content

The Platform and Services monitor and store information transmitted from the devices where the Think Track Software is installed, including activity logs, usage analytics, and certain communications (“User Content”). You and your users retain ownership of such content. You grant Think Track a license to process and store such data for service provision purposes only.

5. Fees

The fees for paid plans are set out at www.thinktrack.app. You agree to pay the applicable fees according to your chosen plan. Payments are non-refundable.

6. General

Links: Our Platform may contain links to third-party websites. We are not responsible for their content or actions.

No Warranty: Your use of the Think Track Platform and Services is at your sole risk. They are provided “as is” and “as available,” without any warranties.

Liability Limitation: To the maximum extent permitted by law, the Company is not liable for any damages, loss of data, or consequential losses resulting from your use of Think Track.

Law and Jurisdiction: These Terms are governed by U.S. law. Any disputes shall be resolved in the courts of the City of Bronx, New York, unless otherwise required by consumer law.
